Louisiana has some strange laws, in part, because their legal system is based upon the Napoleonic Code, rather than British common law, but this is ridiculous. It took more than the judge to get to this point. It took a prosecutor who determined what specific crime would be charged. Considering the reported circumstances, it's surprising that a lesser crime was not charged with a plea bargain resulting in a much shorter incarceration period.
